Terms of Use

These Terms of Use ("Terms") are a contract between you and [OPERATOR] ("we", "us"), the operator of the Helix Gamer mobile application and the website at helixgamer.com (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who can use Helix Gamer

• You must be at least 13 years old, or the minimum age of digital consent where you live if that is higher (for example, 16 in parts of the EU).
• You must be able to form a binding contract with us, and not be barred from using the Service under the laws of your country.
• One person, one account. You are responsible for everything that happens under your account and for keeping your login secure.

2. What Helix Gamer does

Helix Gamer lets you bring in your Steam library, rate and review the games you own, and discover other players whose ratings line up with yours ("Helixers"), along with game recommendations drawn from those matches. Game titles, artwork, prices, release dates and similar information come from Steam's public APIs and other third parties, and may be incomplete, out of date, or unavailable.

3. Linking your Steam account

To use most of the Service you connect a Steam account. When you do, we access and store information Steam makes available for that account — see the Privacy Policy for the specifics. You are responsible for making sure you have the right to connect that Steam account. Your use of Steam is governed by Valve's own terms; Helix Gamer is not affiliated with, endorsed by, or sponsored by Valve Corporation.

4. Your content

"Your Content" means the ratings, written reviews, username, profile details and anything else you submit. You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display and distribute Your Content within the Service for the purpose of operating and improving it (for example, showing your review to other members, or using your ratings to compute matches). This licence ends when you delete the content or your account, except for copies retained in routine backups for a limited period, and except where the content has already been shared with others in a way that cannot be unwound.

You are responsible for Your Content and confirm that you have the right to post it and that it does not break these Terms or the law.

5. Rules of use

When you use Helix Gamer, you agree that you will not:

• Post dishonest ratings or reviews. Ratings and reviews must reflect your genuine opinion of a game you actually own or have played. No review-bombing, no coordinated rating campaigns, no paid, incentivised or fake reviews.
• Post hateful, abusive or illegal content. No hate speech, slurs, racism, antisemitism, harassment, bullying, threats, incitement to violence, doxxing, sexual content, or content that is otherwise unlawful. This is actively enforced — see our Community Guidelines.
• Impersonate any person or organisation, or misrepresent your affiliation with anyone.
• Misuse the Service — no scraping or bulk data extraction, no automated access except as we expressly allow, no attempts to probe, breach or circumvent security or access controls, no reverse engineering except to the limited extent the law allows, no interfering with other members' use of the Service, and no uploading of malware.
• Break the law or use the Service to help anyone else break it.

6. Moderation and account action

We may review content and accounts, remove or hide content, limit features, and suspend or permanently terminate accounts that break these Terms or the Community Guidelines. In broad terms:

• Serious violations — hate speech, threats, harassment, doxxing, sexual content, or anything illegal — result in an immediate permanent ban, with no strike or warning.
• Lesser violations — spam, incivility, borderline conduct — may result in a temporary suspension of around 7 days and a strike on the account. Three strikes leads to a permanent ban.

We aim to be fair and proportionate, and you can contact us at support@helixgamer.com if you believe an action was a mistake, but we make the final decision. A banned or suspended account is not entitled to a refund of any unused subscription time.

7. Membership and billing

• Core features are free. An optional paid membership removes the free-tier library limit and supports the Service. Current pricing is shown in the app.
• Subscriptions are sold, billed and managed through the Apple App Store (and, in future, Google Play). Payment is charged to your store account. We never see or store your card details.
• Subscriptions renew automatically at the then-current price until you cancel. Cancel any time in your App Store account settings; cancellation stops future renewals and takes effect at the end of the current billing period. It does not refund the current period.
• A suspension or ban does not stop your store subscription from renewing — you must cancel it yourself in your store settings.
• Refund requests are handled by Apple (or Google) under their policies, not by us.
• We may change pricing or the features included in a plan. Material changes to an existing paid plan will be notified in advance and take effect at your next renewal.
• Promotional free periods (such as a founder period or bonus months for rating and reviewing) are granted at our discretion and may be changed or withdrawn for future users.

8. Intellectual property

The Service, including its software, design, branding, the "Helix Gamer" name and logo, and all content we create, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not give you any right to use our branding except as needed to use the Service normally. Third-party trademarks, game titles and artwork remain the property of their respective owners.

9. Third-party services

The Service relies on third parties including Valve/Steam (game and profile data), our hosting and database provider, and Apple/Google (authentication and payments). We are not responsible for those services, their availability, or their terms, and your use of them is subject to their own agreements.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that recommendations, matches or third-party data will be accurate or suitable for any purpose. Nothing in these Terms excludes any liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or relating to your use of (or inability to use) the Service. Our total liability to you for all claims relating to the Service in any 12-month period will not exceed the greater of (a) the amount you paid us for the Service in that period, or (b) US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and this clause does not limit rights you have as a consumer that cannot be limited by contract.

12. Indemnity

You agree to indemnify and hold us harmless from any claims, losses and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms — except to the extent the claim results from our own breach or negligence.

13. Changes to the Service and these Terms

We may change, suspend or discontinue any part of the Service at any time. We may update these Terms; if a change is material we will give reasonable notice (for example, in the app or by email) and, where the change affects your rights, ask you to accept the updated Terms before continuing to use the Service. Continued use after an update means you accept it.

14. Termination

You can stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access as described in section 6, or if we reasonably believe it is necessary to protect the Service or other members. On termination, the licences you granted us end (subject to the backup and already-shared exceptions in section 4), and sections that by their nature should survive — including 4, 8, 10, 11, 12 and 15 — will survive.

15. Governing law and disputes

These Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-laws rules, and the courts of [JURISDICTION] will have exclusive jurisdiction, except that if you are a consumer you may also have the right to bring proceedings in your own country of residence, and you keep the benefit of any mandatory consumer protections there.
